Chris,

We might talk privately, as I also had to retrieve my non-running car (from out of state)
while under body repair.  My situation was different, but still ended in litigation to get
the remaining parts back, which was less than 100% successful.
The good news for me was the shop in possession was "good" and honest, the person
in charge of managing the task was not.  I had to pay the shop on the spot for the work
previously done (and for which the "manager" had already been paid by my insurance
company.)

Paying a cop (off duty) to attend is a good thing.  Normally having a cop (on duty) attend
is called a "Civil Standby".  They are ONLY there to keep things from getting "illegal".

Cops are not there to assist anyone... that is a civil (non-criminal) matter, not their
responsibility.

I didn't have a cop present, but my Concealed Weapons Permit is valid in Nevada - grin.
And I have the temperament and training not to use deadly force unless justified.

So you might start by telling the engine "installer" that you are ready to pay him off
(his motivation to be present and let you take the car) and take the car as is.

In situations like this you MUST separate your feelings and temper from the cold reality
of the necessary (and unpleasant) task at hand.

Arrive with the flat bed, boxes, etc... video camera, and friends to help and the cop, and
make it happen quickly... Don't bother to discuss ANYTHING.  Just get your car and parts
and leave.  Pay him a fair price IF you owe him anything, and get a receipt.
(I had to pay thousands! but he was honest, and worth every penny!  I even paid him to do
additional work - he was that good, that honest, and that fair-priced.)

Once you are back in possession, deal with your main contractor at your leisure.

I think that's the way to go.  The challenge is figuring out when the mechanic will be at
the garage.  if he's not there it's locked, and there's no guarantee the homeowner to whom
the garage actually belongs will be home, either.

 

Maybe I can get the policeman to shoot off the door lock like they do on TV...!
