It is a design patent which only protects the appearance not the function.  The butterfly is shown in solid lines and is what the patent protects, the details of the rest of the carb are just to show where it fits.  It would be distinguished from the old Holley 3 barrel because the Holley had a simple oval shape, not the goggle shape. 
 
It's usually pretty easy to get design patents issued, but if someone make something that looks different, it will avoid infringment.  Anyone would be free to make something like the old Holley design.

For all you folks still using "old school" carburetors, here is some 
news in which you may be interested.

In essence, to maximize the air flow Demon created the Goggle valve. 
Without it, generating air flow of up to 750cfm would have been almost 
impossible.
