Don’t remember the settlement details but the flower shop owner was essentially made whole for his legal fees.  

 

In my opinion you would not have had super digs within the hotel and a garage full of panteras because that offer was not made.  No  business that has been around for that long is ran by idiots.  I’m sure that any offer was given its due and determined to not be in the best interest of the business.  Would you still settle if the offer would not allow you to have a garage full of Pantera’s but rather required you to relocate your business and lose your identity with that location??  Apparently the owner was not interested in rebuilding his brand in a new location and the billionaire was not interested in giving him super digs and a garage full of panteras.

 

You got to remember that negotiations go both ways.  Most people are not willing to “pay” to make a point.  However most are willing to defend their property when forced.   The billionaire spent WAAAAAAy more than it would have cost to make a fair market value offer for the property, several years in court if I remember correctly.  Any good attorney would have told him to try to negotiate and reach a settlement, it would be cheaper in the end.  The billionaire always thought the city would condemn or seize the property under eminent domain so he was not willing to make the necessary offer and instead took the bully approach.  Offense was taken and battle plans drawn.  I remember that public opinion ran strong against the billionaire for his tactics and arrogance.

 

BTW, I think your idea of sweet digs and lots of pateras is the better approach, however I would have to mix in a couple other cars as well.

If it had been me, My flower shop would have new SUPER digs inside the hotel with easy outside access, rent free and I'd have a whole building full of Panteras with the money I got as well.

billionaire wanted to build an incredibly beautiful hotel.  He bought out
everyone on the block except one tiny flower shop.  The owner had been there
for decades and did not see why he should have to sell.  The billionaire
took him to court and lost at every level (state supreme court).  He then
went the eminent domain route with the city playing the part of the "heavy".
He lost again at every level.  Today there is a beautiful hotel that covers
almost the entire block, all except for one small corner that has a tiny
flower shop in an old building.  I think of it at a monument to the "little
guy"

The government stealing intellectual property from a company is just
un-American. Thousands of hands have worked on making those brands what they
are, and the company is the one that should benefit from that work. What you
are proposing would undermine our economic system as people wouldnšt have
the protection to prosper from their ideas and labor.

I am against the eminent domain of homes as well. Especially when property
is turned over to private business. Building a freeway for the benefit of
citizens? Ok, maybe. But taking property so the local government can simply
generate more tax revenue for itself is just tacky.

My two pennies.

By the way, do I respond to all, or just detomaso at realbig.com when I want to
comment? Sorry, new here.  :-)
