I would guess it is better to slightly overfill verses underfill.  Although, I doubt there is much chance of overfilling unless you were able to hang the car from its tail.  Regardless, 3.5 is ample.  

The consequence of running the ZF cover plate down is that the output shaft rather than the input shaft gets bathed in oil.  The input shaft has first gear cut into it and most of the syncros and bearings.  Ideally, it would be bathed in oil for running and storage protection.  I opine that a higher oil level provides it better protection.
