Dont depend on it, it is better to have the oil level at a longer distance 
from the crank.
So, the pan can be made deeper and store enough oil in its lower region. It 
also depend
on how effective the the design of the baffling are, and moost of all, how 
effective the
windage-oil separation baffles are.  The better, the smaller tha pan could 
be made.
The pan manufacturer should know what crank to oil distance should be (at 
least) for
the specific pan.
